Having served the world’s shipping industry since 1883, we are universally regarded as one of the world’s leading shipping law firms. The reputation of our marine and admiralty departments, and the enduring relationships developed by our firm with the owners and operators of yachts and commercial vessels throughout the world form the foundation of our current practice. Our yacht team has been an integral part of the yachting industry for over 30 years and has a physical presence in many of the major yachting jurisdictions. Its in-depth knowledge of this intimate industry, combined with its global reach, ensures it is pre-eminent in the provision of legal services to yachting. We recognise that the industry is driven by a small group of high and ultra-high net worth individuals whose acquisition of a yacht and the drivers for doing so are usually quite separate to any business activities they may undertake and where issues of discretion and confidentiality are often of paramount importance.

We provide full service legal support to the yachting industry and advise on all legal issues a yacht is likely to encounter during its life, including:.
• Design agreements and intellectual property issues
• Construction agreements
• Pre and post-delivery financing, restructuring and work out arrangements
• Yacht sale and purchase transactions
• Ownership structures
• Registration arrangements
• Import and export formalities
• VAT/Customs issues
• Management agreements
• Crewing and employment matters
• Refit and repair contracts
• Charter agreements
• Sale and purchase of berths
• Physical and cyber security arrangements
• Health, safety and regulatory compliance
• Business jets and helicopters
• Tenders, submersibles and other ancillary equipment
• Yacht arrest and dispute resolution
• Admiralty and crisis management
• Insurance arrangements, including questions of coverage

We also support owners with legal issues concerning related assets, such as berths, tenders, submarines, helicopters and business jets.

Robert Allen Law is best known for its experienced team of attorneys who counsel and guide clients through the legal challenges and complexities of yachting and super yacht matters, including construction, buying, selling, chartering, financing, the brokerage business, and related litigation and arbitration.

Intensely focused on the yacht industry, the firm is a highly respected player in the industry and a reference to its peers. Serving as a legal advisor to several of the world’s leading yacht manufacturing groups and brokerages, it is also the principal legal advisor to the leading trade industry association for yacht brokers throughout the world.

The Robert Allen Law team brings together lawyers with diverse legal backgrounds and language capabilities. Its transaction lawyers, trained primarily in the corporate world, and its litigators, trained in the civil and criminal law fields, bring their experience to yacht transactions and the yacht business itself – supported by a senior lawyer who is also a professor of maritime and admiralty law. As a result, they are uniquely equipped to assist clients in the ever-increasingly global market of the yachting industry. In practical terms, their lawyers combined experience in the yacht field exceeds a century and its lawyers and staff are fluent in English, Italian, Spanish, Portuguese and Russian.

Distinct from most “yacht law” firms, several Robert Allen Law attorneys worked in leading corporate and international law firms specializing in mergers and acquisitions, banking and finance and other business matters, making Robert Allen Law perhaps the leading corporate law firm in the world with a focus on the yachting industry. Because of these backgrounds and broad ranges of experience, the firm is also regularly engaged on behalf of lenders with respect to yacht financing transactions, as well as yacht builders – for buyers and manufactures – doing business internationally, wherever yachts are built and wherever buyers, sellers and banks are located.

In addition to its yacht transaction team, the firm’s litigation practice is well established and unique among law firms focused on the yacht field in the United States. When disputes arise, the firm’s experience in mediation, arbitration, and pre-trial matters, allows Robert Allen Law attorneys (including a former yacht captain) to assist clients with assessment of risks, as well as alternative, and often more efficient ways to resolve matters. When litigation is required, the firm also offers unique value in terms of trial experience because its team consists of industry veterans, including the current chairman of a Marine Arbitration Council, and attorneys who prosecuted for the State of Florida or defended those prosecuted.

The VISR also enforces the regulations applicable to Virgin Islands vessels wherever they may be, and for all vessels navigating in the territorial waters of the Virgin Islands. The VISR develops appropriate standards of training, evaluation and certification for Virgin Islands seafarers and on-shore staff in accordance with the respective needs of international and domestic shipping and the BVI maritime industry, and it provides timely, accurate and appropriate information and advice to the Government, public and private sector organisations and the general public. Ship registration provides a revenue stream to the BVI through the registration fees for ships and seafarers, and also for the corporate registration of the companies set up in the BVI to own and represent the ships. Ships registered in the BVI are British Ships and fly the Red Ensign. The UK Secretary of State for Transport has the general superintendence of the Red Ensign Group of Registries (REG) in all matters relating to merchant shipping and seafarers. The Maritime and Coastguard Agency (MCA) is the executive Agency of the Department of Transport responsible for maritime administration and has a supervisory role to ensure that the VISR (and other REG administrations) maintain the highest international standards in accordance with their obligations under the Conventions and in line with UK policy.
